2. Capacity and registration

2.1. Only individuals over the age of eighteen with full legal capacity, and duly constituted legal entities represented by someone with authority to do so, may purchase.

2.2. You are responsible for the accuracy and for keeping up to date the data you provide. Incorrect data may prevent delivery, and the cost of re-shipping arising from an error in your details is your responsibility.

2.3. Your login and password are personal and non-transferable. Notify us immediately of any unauthorised use of your account.

2.4. We may refuse or cancel registrations and orders where there is an indication of fraud, false information, breach of these Terms or unauthorised resale.

2.5. Scope. These Terms govern exclusively sales to the end consumer, for personal use. Orders intended for resale, distribution, commercial agency, corporate use, corporate gifting, export or any other form of intermediation are not accepted through this channel and, where there is mutual commercial interest, are governed by a specific written agreement entered into with Ghalya. The provisions of these Terms concerning the right of withdrawal, the goodwill exchange periods and the jurisdiction of the consumer's domicile do not apply to that agreement, as it is not a consumer relationship.

2.6. Purchase limits. We may limit the number of units per order, per CPF or CNPJ, per payment method and per delivery address, and may refuse, cancel or refund orders where there is objective evidence of purchase for unauthorised resale, of misuse of coupons, or of the splitting of orders to circumvent those limits. In that event, any amounts paid are refunded in full and at no cost to you.

3. Products

3.1. We sell perfumes and perfumery products under the GHALYA brand. The descriptions, olfactive notes, volumes and longevity information published on the site are given in good faith and reflect the characteristics of the product supplied.

3.2. Images are illustrative. Small variations in the shade of the liquid, the label and the packaging may occur between production batches, without affecting the quality or the composition of the product.

3.3. The perception of a fragrance is subjective and varies with skin chemistry, temperature and humidity. The longevity and projection stated are average references and do not constitute a guarantee of performance.

3.4. Safety warning. Perfumery products contain alcohol and potentially allergenic substances. For external use only. Keep away from flame, heat and direct sunlight. Do not apply to broken or irritated skin. In the event of a reaction, discontinue use and seek medical advice. Keep out of reach of children. Before first use, we recommend testing on a small area of skin. The full ingredient list appears on the packaging and on the product page.

3.5. The products sold comply with the applicable Brazilian health regulations for personal hygiene products, cosmetics and perfumes. Registration details with the National Health Surveillance Agency appear on the packaging and on the product page.

3.6. Products are sold for personal use. Resale without prior written authorisation is prohibited.

3.7. Batch variation and reformulation. Perfumes are composed of natural and synthetic raw materials and are subject to variation between production batches and to the evolution of technical and health standards. The composition may be adjusted because of International Fragrance Association restrictions, of a requirement of the National Health Surveillance Agency, or of the unavailability or substitution of a raw material, while always preserving the olfactive identity of the fragrance and the quality of the product. Perceptible differences of intensity between batches, within that margin, do not constitute a defect in the product.

3.8. Shelf life and storage. The best-before date and the period of use after opening appear on the packaging. Kept in its original packaging, in a cool place away from light and heat, the product retains its characteristics until the date indicated.

4. Prices, offers and availability

4.1. Prices are stated in reais and already include applicable taxes, unless stated otherwise. Shipping costs and any additional charges are calculated and displayed separately before the order is completed.

4.2. Prices may change at any time without prior notice. The price applying to an order is the one in force at the moment the order is completed.

4.3. Offers and coupons are valid only for the period and on the conditions published, while stocks last, and cannot be combined with one another unless expressly stated.

4.4. Where there is an obvious error of price or description arising from a system, typing or integration failure, we may cancel the order before dispatch, notifying you immediately and refunding in full any amount paid. This clause does not apply to price differences arising from legitimate promotions.

4.5. Advertised products are subject to stock availability. Should an item sell out after the order is confirmed, you may choose between waiting for restocking, substituting the product or receiving a full refund.

4.6. Coupons and promotional codes. Coupons and promotional codes are personal, non-transferable, hold no monetary value, are not convertible into cash and may be used only on the conditions, within the periods and through the channels in which they were published. We may suspend, cancel or refuse the application of a coupon in the event of unauthorised publication, of reproduction on deal aggregation sites, of automated use, or of any use inconsistent with the purpose of the campaign, without affecting orders already confirmed and delivered.

4.7. Pre-orders and limited editions. Products offered as a pre-order or as a limited edition are identified as such on the product page, with the expected availability date and the quantity offered. In those cases, the delivery estimate runs from the stated availability date and not from payment confirmation. Should that date be postponed, we will notify you and you may either keep the order or cancel it, with immediate and full refund of the amounts paid.

5. Payment

5.1. We accept credit and debit cards of the schemes shown at checkout, among them Visa, Mastercard and American Express, Pix, bank slip (boleto) and the Apple Pay and Google Pay digital wallets. Transactions are processed by Stripe.

5.2. Instalment payment, where available, follows the conditions displayed at checkout and the rules of the financial institution.

5.3. Every order goes through a security and fraud prevention review. We may request additional documents to confirm ownership of the payment method. Orders not approved in that review are cancelled at no cost, with a full refund.

5.4. The order is only processed after payment is confirmed by the financial institution.

6. Formation of the contract

6.1. Before completion, the site presents a summary of the order with products, quantities, price, shipping, delivery time and address, together with tools to correct any errors in what you have entered.

6.2. Completing the order generates immediate electronic confirmation that your acceptance has been received. The contract of sale is formed when payment is confirmed.

6.3. A copy of these Terms, of the order summary and of the invoice remains available for consultation, download and printing in your account and by email.

7. Delivery

Delivery times, costs, regions served and tracking rules are described in the Delivery, Exchange and Returns Policy, which forms part of these Terms for all purposes.

8. Right of withdrawal

8.1. Under article 49 of the Consumer Protection Code, you may withdraw from the purchase within seven calendar days of receiving the product, without giving a reason and at no cost.

8.2. A withdrawal request may be made through the same channel used to place the order or through the customer service channels listed in section 1. We will send immediate confirmation that your notice has been received.

8.3. Exercising the right of withdrawal also terminates any ancillary contracts, at no cost to you.

8.4. Amounts paid, including outbound shipping, are refunded in full and adjusted for inflation. The cost of return shipping is borne by us.

8.5. The operational conditions of the return are set out in the Delivery, Exchange and Returns Policy.

8.6. To exercise the right of withdrawal, the product must be returned in its original packaging, with everything that accompanies it and with the security seal of the box. Where use beyond what is required to inspect the product is established, with a reduction in the contents of the bottle, the amount refunded may be adjusted in proportion to the depreciation, in which case we will tell you the amount and the basis of the adjustment in advance, as set out in the Delivery, Exchange and Returns Policy.

9. Legal warranty and product defects

9.1. Under article 26, item II, of the Consumer Protection Code, the period for complaining about apparent or easily detected defects in a durable product is ninety days from delivery.

9.2. In the case of a hidden defect, the period begins at the moment the defect becomes apparent.

9.3. Where a defect is established and not remedied within the legal period of thirty days, you may require, at your choice, replacement of the product, immediate refund of the amount paid with inflation adjustment, or a proportionate reduction in price, under article 18, paragraph 1, of the Consumer Protection Code.

9.4. The warranty does not cover damage arising from misuse, improper storage, exposure to heat or sunlight, drops, tampering with the product or natural wear through use.

10. Customer service

10.1. We maintain an electronic customer service facility for questions, complaints, suspension and cancellation of contracts, through the channels listed in section 1.

10.2. We confirm receipt of your request by the same means you used and respond within five days, in accordance with article 4, item VI, of Decree no. 7,962/2013.

10.3. Cancellation requests are processed immediately and the corresponding service record is provided to you.

11. Intellectual property

11.1. The GHALYA brand, the logo, the fragrance names, the texts, the photographs, the videos, the bottle design, the visual identity and the site code are protected by intellectual property rights and belong to BASIL AND MATHEUS TRADING CO. L.L.C or to its licensees.

11.2. Reproduction, distribution, modification, reverse engineering or commercial use of any content without prior written authorisation is prohibited.

11.3. By posting reviews, photographs or videos on our channels, or by tagging Ghalya in posts on your public profiles, you grant Ghalya a free, non-exclusive, worldwide licence to reproduce that content in promotional material, crediting your profile where applicable. You may withdraw that licence at any time by writing to contato@ghalyaperfumes.com. Withdrawal takes effect for the future: we stop new placements and remove the content from the channels under our control within thirty days, while material already produced and placements already booked remain until the end of the relevant campaign.

12. Use of the site

You agree not to use robots, scrapers or automated means to extract data; not to attempt to access restricted areas or compromise the security of the site; not to publish illegal, offensive or defamatory content or content that infringes the rights of third parties; not to use the store for fraudulent purposes or money laundering; and not to resell the products without authorisation.

13. Limitation of liability

13.1. Nothing in these Terms excludes or limits the rights that Brazilian consumer legislation guarantees you.

13.2. We are not liable for temporary unavailability of the site arising from maintenance, third-party failures, cyber attacks, unforeseeable circumstances or force majeure, nor for delivery delays caused by events beyond our control, such as strikes, natural disasters and customs operations.

14. Data protection

The processing of your personal data is governed by our Privacy Policy, which forms part of these Terms.

15. Changes

We may change these Terms at any time. The version applying to your order is the one in force on the date it was completed. The date of the last update appears at the top of the document.

16. Governing law and jurisdiction

16.1. These Terms are governed by the laws of the Federative Republic of Brazil.

16.2. The courts of the consumer's domicile are chosen to settle disputes, in accordance with article 101, item I, of the Consumer Protection Code.

16.3. Before going to court, you may register your complaint on the consumidor.gov.br platform or with the Procon in your city.

16.4. In relationships that do not constitute a consumer relationship, as set out in clause 2.5, the courts of the district of TORELLO GROUP LTDA's registered office are chosen, with express waiver of any other, however privileged.
