2. Eligibility and account

2.1. You must be at least eighteen years old and legally capable of entering into binding contracts in order to purchase from this site.

2.2. You are responsible for the accuracy of the information you provide. Incorrect delivery details may prevent delivery, and any re-shipping costs arising from an incorrect address are payable by you.

2.3. Your login credentials are personal. Notify us immediately of any unauthorised use of your account.

2.4. We may refuse or cancel any order or account where we detect fraud, false information, breach of these Terms or unauthorised resale.

2.5. Scope. These Terms govern sales to end consumers for personal use. Orders intended for resale, distribution, agency, corporate use, corporate gifting, export or any other form of intermediation are not accepted through this site and, where commercially agreed, are governed by a separate written commercial agreement. The provisions of these Terms concerning the voluntary returns window and the consumer remedies described in clause 8 do not apply to that agreement.

2.6. Purchase limits. We may limit the number of units per order, per customer, per payment method and per delivery address, and may refuse, cancel or refund any order where there is objective evidence of purchase for unauthorised resale, misuse of discount codes, or the splitting of orders to circumvent those limits. Any amount already paid is refunded in full and at no cost to you.

3. Products

3.1. We sell fragrances and perfumery products under the GHALYA brand. Descriptions, olfactory notes, volumes and concentration levels shown on the site are provided in good faith and reflect the product supplied.

3.2. Product images are illustrative. Minor variations in liquid tone, label and packaging may occur between production batches without affecting the quality or composition of the product.

3.3. The perception of a fragrance is subjective and varies with skin chemistry, temperature and humidity. Any indication of longevity or projection is an average reference and not a guarantee of performance.

3.4. Safety notice. Fragrance products contain alcohol and potentially allergenic substances. For external use only. Keep away from open flame, heat and direct sunlight. Do not apply to broken or irritated skin. Discontinue use and seek medical advice if irritation occurs. Keep out of reach of children. We recommend a patch test before first use. The full ingredient list appears on the packaging and on each product page.

3.5. Our products are cosmetic products. We make no medical, therapeutic or pharmacological claims, and nothing on this site should be read as such.

3.6. Products are sold for personal use. Resale without our prior written authorisation is prohibited.

3.7. Batch variation and reformulation. Fragrances are composed of natural and synthetic materials and are subject to variation between production batches and to changes in technical and regulatory standards. The composition may be adjusted as a result of International Fragrance Association restrictions, of regulatory requirements in any market we serve, or of the unavailability or substitution of a raw material, while preserving the olfactory identity and the quality of the product. Perceptible differences of intensity between batches, within that margin, do not constitute a defect.

3.8. Shelf life and storage. The best before date and the period after opening are shown on the packaging. Kept in its original packaging, away from light and heat, the product retains its characteristics until the date indicated.

4. Prices and availability

4.1. Prices for delivery within the United Arab Emirates are shown in UAE Dirhams. Where value added tax applies to your order, it is calculated and shown at checkout and on the tax invoice, together with our tax registration number. Shipping charges are calculated and displayed separately before you complete your order.

4.2. Where the site displays another currency, that price is a conversion provided for your convenience. The final amount charged and the applicable exchange rate are determined by your card issuer.

4.3. Prices may change at any time without notice. The price applicable to your order is the one displayed at the moment the order is placed.

4.4. Promotions and discount codes are valid only for the period and under the conditions published, while stocks last, and cannot be combined unless expressly stated.

4.5. Where an obvious pricing or description error occurs due to a system, data feed or typographical fault, we may cancel the order before dispatch, notify you immediately and refund any amount paid in full.

4.6. All products are subject to availability. If an item becomes unavailable after your order is confirmed, you may choose to wait for restocking, substitute the product or receive a full refund.

4.7. Discount and promotional codes. Codes are personal, non transferable, hold no monetary value, are not exchangeable for cash and may be used only on the terms, within the period and through the channels in which they were issued. We may suspend, cancel or refuse a code where it has been shared without authorisation, republished on deal aggregation sites, used by automated means, or otherwise used contrary to the purpose of the campaign, without affecting orders already confirmed and delivered.

4.8. Pre orders and limited editions. Products offered on pre order or as a limited edition are identified as such on the product page, together with the expected availability date and the quantity offered. For those products the delivery estimate runs from the stated availability date and not from payment confirmation. If that date moves, we will notify you and you may either keep the order or cancel it for an immediate and full refund.

5. Orders and formation of contract

5.1. Your order is an offer to buy. We accept that offer, and the contract is formed, when we send you the dispatch confirmation, and not when the order confirmation is issued.

5.2. Before you complete your purchase, the checkout displays a summary of the products, quantities, price, VAT, shipping cost, estimated delivery time and delivery address, and allows you to correct any input errors.

5.3. A copy of your order and tax invoice is sent to you by email and remains available in your account.

6. Payment

6.1. We accept credit and debit cards of the schemes displayed at checkout, including Visa, Mastercard and American Express, and the Apple Pay and Google Pay wallets. For orders delivered within the Gulf Cooperation Council we also offer the instalment options Tabby and Tamara, where available for your country and order value. Payments are processed by Stripe.

6.2. Every order is subject to fraud screening. We may request additional documents to verify ownership of the payment method. Orders that fail screening are cancelled at no cost and fully refunded.

6.3. Where instalment or deferred payment options are offered, they are provided by third party financing partners under their own terms, which you accept separately at checkout.

7. Delivery

Delivery times, costs, destinations, customs duties and shipping restrictions are set out in our Shipping and Returns Policy, which forms part of these Terms.

8. Returns, exchanges and faulty goods

8.1. Our voluntary returns window and its conditions are set out in the Shipping and Returns Policy.

8.2. Nothing in these Terms limits your statutory rights under UAE Federal Law No. 15 of 2020 on Consumer Protection and Cabinet Decision No. 66 of 2023. Where a product is defective, does not match its description or is unfit for its purpose, you are entitled to have it repaired, replaced or refunded at no cost to you, and any notice stating that no refunds are given does not override that right.

9. Intellectual property

9.1. The GHALYA name and logo, the fragrance names, the bottle and cap design, all text, photography, film, packaging artwork and the code of this site are protected by intellectual property rights owned by or licensed to BASIL AND MATHEUS TRADING CO. L.L.C.

9.2. Reproduction, distribution, modification, reverse engineering or commercial use of any of this content without our prior written consent is prohibited.

9.3. By posting reviews, photographs or videos on our channels, or by tagging Ghalya in posts on your public profiles, you grant us a free, non exclusive, worldwide licence to reproduce that content in our marketing materials, crediting your handle where applicable. You may withdraw this licence at any time by writing to contact@ghalyaperfumes.com. Withdrawal takes effect for the future: we will stop new placements and remove the content from the channels under our control within thirty days, while material already produced and placements already booked may run until the end of the relevant campaign.

10. Acceptable use

You agree not to use bots, scrapers or automated means to extract data from the site; not to attempt to access restricted areas or compromise site security; not to post unlawful, offensive, defamatory or infringing content; not to use the store for fraudulent purposes or money laundering; and not to resell our products without authorisation.

11. Liability

11.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under UAE law.

11.2. Subject to clause 11.1, our total liability arising out of or in connection with any order is limited to the amount you paid for that order.

11.3. We are not liable for indirect or consequential loss, or for delays and failures caused by events beyond our reasonable control, including strikes, natural events, customs inspections, carrier disruption, airspace restrictions and cyber attack.

12. Data protection

The processing of your personal data is governed by our Privacy Policy, which forms part of these Terms.

13. Changes

We may amend these Terms at any time. The version that applies to your order is the one in force when the order was placed. The date of the latest revision appears at the beginning of the document.

14. Governing law and jurisdiction

14.1. These Terms and any dispute arising from them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.

14.2. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer protection rights available to you in your country of residence.

14.3. Before commencing proceedings, you may file a consumer complaint with the UAE Ministry of Economy and Tourism through the consumer protection hotline 600 522 225, or through the Dubai Consumer channels of the Dubai Department of Economy and Tourism.
